Terms of Service

This is a template drafted for VitalSite's launch and has not been reviewed by DACH counsel. Replace the placeholder legal-entity details below and obtain a qualified legal review before relying on it.
1. Acceptance of these Terms
By creating an account or using VitalSite (the "Service"), you agree to these Terms of Service and to our Privacy Notice. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization.
2. What the Service does
VitalSite runs automated scans of websites you add to your account, covering security, privacy, SEO, accessibility, performance, and availability/domain/SSL signals. It monitors those websites over time, detects changes, sends alerts, and generates PDF reports. Findings are automated technical observations — see the disclaimer in Section 7.
3. Accounts and eligibility
You must provide accurate account information and keep your credentials secure. You are responsible for activity that happens under your account and organization, including actions taken by members you invite.
4. Scan authorization
You may only add websites you own or have explicit permission to scan and monitor. VitalSite's scanner makes automated HTTP and browser-based requests to the hostnames you configure — adding a site you do not control may violate the target site's terms of service or applicable computer-misuse law, and is your responsibility, not VitalSite's.
5. Subscriptions and billing
Paid plans are billed in advance on a recurring basis through our payment processor (see Subprocessors). Plan limits (sites monitored, scan frequency) are described at checkout and on our pricing page. You can cancel or change your plan at any time through the billing portal; changes take effect per the terms shown there.
6. Acceptable use
You agree not to:
- Use the Service to scan or monitor a website without authorization;
- Attempt to circumvent the Service's rate limits, tenant isolation, or security controls;
- Use the Service to store or transmit unlawful content;
- Resell or white-label the Service beyond what your plan's reporting features permit.
7. No warranty; disclaimer
The Service is provided "as is." Scan results, health scores, and reports are automated technical observations. They are not legal advice and do not constitute a compliance certification (for example, under GDPR). Automated accessibility checks cannot determine full WCAG conformance. Findings should be reviewed by a qualified professional where compliance decisions are required.
8. Limitation of liability
To the maximum extent permitted by law, VitalSite is not liable for indirect, incidental, or consequential damages arising from use of the Service, including decisions made in reliance on automated findings.
9. Data protection
Our processing of personal data is described in the Privacy Notice. Our subprocessors and data-processing agreement are described on the Subprocessors page.
10. Termination
You may delete your organization at any time from Organization Settings, which stops monitoring and schedules your data for deletion subject to the retention exceptions described in our Privacy Notice (for example, billing and audit records kept only as long as legally required). We may suspend or terminate access for material breach of these Terms.
11. Governing law
These Terms are governed by the laws of [Member State — placeholder], without regard to conflict-of-law rules, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.
12. Changes to these Terms
We will post material changes here with an updated version and effective date, and notify organization owners by email in advance of changes that materially reduce your rights.
